All collectibles displayed on this website (e.g., postcards, vintage advertisements, magazines) are original physical items offered for sale. The images shown are used exclusively for the illustration and presentation of these physical original items. Terms and Conditions (AGB)

1. General

These Terms and Conditions (AGB) govern all legal relationships between Cedric Christopher Merkli Photography + Visual Work / Edition Tuttifrutti and its customers (buyers), whether through the online shop (editiontuttifrutti.com) or via email (edition.tuttifrutti@icloud.com). Any conflicting buyer stipulations are expressly excluded.

3. Offer and Delivery

All offers on www.editiontuttifrutti.com are non-binding. Product information is for illustrative purposes and may slightly deviate from the actual product (e.g., color, format). Price and product range changes, as well as technical modifications, are reserved. Offers are valid only as long as they are visible online and while stocks last.

Product Condition: Each collectible is a unique item from historical stock. Age-related signs of wear are not defects but part of their authenticity.

4. Orders and Deliveries

Orders and deliveries are currently only possible within Switzerland and Liechtenstein. By submitting an order and confirming the AGB, the buyer submits a legally binding offer. Shipping methods and costs are transparently displayed during the order process. Delivery times are non-binding, and delivery is at the buyer’s risk and expense. Transport damages must be reported within 48 hours with photographic evidence via email. The average delivery time is 3–7 business days. Shipping is climate-neutral via Swiss Post.

5. Shipping Costs and Customs

Shipping costs are a flat rate of CHF 3.50 per order. Shipping is free for orders above CHF 50.–. For deliveries to Liechtenstein, additional costs (e.g., customs or import duties) may apply, which are borne by the buyer. Liechtenstein consumers are subject to applicable local consumer protection laws where mandatory.

6. Prices and Payment

All prices are in CHF, including VAT. Payment methods: credit card, PayPal. Payment is charged on the order date. The seller reserves the right to exclude certain payment methods. Goods remain the property of the seller until full payment is received, with the right to register a retention of title. In case of payment default, the seller may withdraw from the contract. PayPal (paypal.com) and Stripe (stripe.com) privacy and payment terms apply.

Confirmed orders are binding and cannot be modified or canceled.

8. Returns, Withdrawal, and Cancellation

The buyer has a 14-day right of withdrawal, starting upon receipt of the goods. The withdrawal can be declared informally via email to edition.tuttifrutti@icloud.com or by post to Cedric Christopher Merkli, Thiersteinerallee 84, CH-4053 Basel, within 14 days. Goods must be returned unused, undamaged, complete, and in original packaging via registered mail. Returns are at the buyer’s cost and risk. Refunds are issued after verifying the item’s condition. Incorrectly ordered products are not accepted or refunded.

9. Warranty and Liability

Defects must be reported in writing within 5 days (hidden defects within 7 days of discovery). For valid claims, a replacement is provided; otherwise, a refund is issued. Further claims are excluded. No liability for improper use, incorrect storage, or wear. Returns are at the buyer’s risk. Unjustified returns may incur inspection and shipping costs. Liability for consequential damages, lost profits, or indirect damages is excluded to the extent permitted by law, as well as for force majeure (e.g., pandemics, war, natural disasters, strikes, supply chain disruptions).

10. Copyright and Image Use

All texts, images, videos, and designs are protected by copyright. Any use without written permission is prohibited. In particular, no image data from the website may be copied, stored, or distributed. Rights to historical images remain with the original rights holders. The sale pertains solely to original physical objects, not digital reproductions.

11. Data Protection

Personal data (e.g., names, addresses, payment information) is processed solely for order fulfillment, delivery, and customer communication, in compliance with the Swiss Data Protection Act (DSG). Data may be shared with third parties (e.g., Stripe, PayPal, Swiss Post) as necessary for order processing. Marketing use (e.g., newsletters) requires explicit consent. 12. Language and Validity

In case of multilingual versions of these AGB, the German version is legally binding.

13. Applicable Law and Jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the Swiss Conflict of Laws (IPRG). For private individuals, consumer protection laws determine the jurisdiction. In all other cases, Basel-Stadt is the exclusive place of jurisdiction.

14. Project Support

With every purchase, you support a cultural project promoting handwritten communication, the visibility of analog design, and the production of new works by contemporary Swiss artists. Edition Tuttifrutti pursues not purely commercial goals but sees itself as part of a small-scale circular economy.

15. Severability Clause

If any provision of these AGB is invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision will be replaced by a provision that most closely achieves its economic purpose.

16. Dispute Resolution

We strive for amicable resolutions in case of disputes. Customers may contact the Swiss Ombudsman for Online Trade for mediation.
